These Terms and Conditions ("Terms") govern the use of the website operated by Xagaho and the participation in the Local Volunteering Program offered through it. By accessing this website or registering for a volunteering placement, you agree to be bound by these Terms, in accordance with the Polish Civil Code (Kodeks cywilny) and, where applicable, the Act of 30 May 2014 on Consumer Rights.

1. Who Provides the Services

2. Placing and Confirming an Order

Participation in the Local Volunteering Program is arranged as follows:

  1. The visitor selects a volunteering program or session displayed on the website and submits a registration request through the available form.
  2. Xagaho reviews the request and sends a confirmation email to the address provided, indicating acceptance of the placement, requested adjustments, or refusal where the program is full or unsuitable.
  3. The contract for participation is considered concluded only upon receipt of this written confirmation from Xagaho, not at the moment of form submission.
  4. It is the responsibility of the applicant to ensure that the contact details submitted are accurate, as confirmation and further communication rely on them.

3. Prices, Payment and What Is Included

Where a fee applies to a specific volunteering program, the applicable price will be clearly displayed on the relevant program page prior to registration. Unless stated otherwise:

Many volunteering placements offered by Xagaho are free of charge. Where this is the case, no payment obligation arises, but the applicant remains bound by the participation conditions described in the confirmation.

4. Cancellation and Complaints

Consumers who register for a paid program have the right to withdraw from the contract within 14 calendar days of confirmation, without giving any reason, in accordance with the Act on Consumer Rights, unless the volunteering activity has already fully taken place with the consumer's explicit consent before the withdrawal period expires.

To exercise the right of withdrawal, please send a clear statement to [email protected], stating your name and the program concerned. Any payments received will be refunded without undue delay, and no later than 14 days from receipt of the withdrawal statement, using the same payment method used originally, unless otherwise agreed.

Complaints regarding the organization, communication, or execution of a volunteering placement may be submitted by email to the address above. Xagaho will acknowledge receipt and respond substantively within 14 days of the complaint being received.

5. Limitation of Liability

Xagaho makes reasonable efforts to ensure that the information published on this website, including program descriptions, dates, and locations, is accurate and up to date. However, Xagaho does not guarantee the absence of errors or omissions and reserves the right to modify or cancel a program before confirmation is issued.

To the extent permitted by Polish law, Xagaho's liability is limited to actual damages directly resulting from proven fault on the part of Xagaho, and excludes indirect or consequential losses. Nothing in these Terms limits liability that cannot be excluded under mandatory provisions of Polish consumer protection law.

Volunteers participate in activities organized in cooperation with local hosts and community partners; Xagaho acts as coordinator and is not liable for actions of independent third parties beyond its reasonable control.

6. Cookies and Privacy

This website sets only one cookie, named consent_state, which stores your cookie consent choice for a period of one year. No analytics, tracking, or session-management cookies are set by this website.

Advertising measurement, where applicable, is activated only after the visitor has given consent, and only operates on the confirmation page shown after registration.

Personal data submitted through the registration form is processed by Xagaho in accordance with the Regulation (EU) 2016/679 (General Data Protection Regulation) and applicable Polish implementing law. Data subjects may exercise their rights, including access, rectification, erasure, and objection, by writing to [email protected]. You also have the right to lodge a complaint with the President of the Personal Data Protection Office (Prezes Urzedu Ochrony Danych Osobowych), the supervisory authority in Poland.

7. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Poland. Any disputes arising from these Terms shall be submitted to the competent Polish courts, without prejudice to any mandatory consumer protection rights available in the consumer's country of residence.
